Topic: Query about versions to upload: size / quality vs paid content vs 'ownership' of image - what takes priority?

Hullo there, sorry if this is in the wrong category, essentially new here. I have a question about what takes precedence when uploading versions of an image.

I'm the person who uploaded This and its variant . It's the highest res version available of it. I've been considering putting up the rest of this artist's stuff, or at least a couple characters she does (fine, fine, I'll come clean, my boyfriend's asura :V ). Obviously, higher-resolution versions are preferred. To make sure, I asked her if she would prefer I upload the hi-res versions that get put onto patreon, or the lower-res 'public' ones she puts on tumblr et al, she said to go with the lower-res ones as the hi-res files are patreon incentives. That's all dandy and good, I'll stick to them.

What throws a spanner in all that is that I'm the person that commissioned the one/s I've currently uploaded. I'm pretty much entirely new to the community, so I don't know what the stance on 'ownership' of an image is in these cases. Basically, does any person commissioning a piece entitle them to do as they will / upload whatever version, or should I stick to the 'public facing' one (and hence replace the existing image with said lower-res one) regardless?

If they dont want you to upload them then you need to respect that, doesnt matter if you are the commissioner or not. Also Patreon and other paysite sourced contents is banned under e621's "Do Not Post" policy for 2 years upon the artists publication of a particular image/ content...

Gotcha, site structure / artist takes priority - I'll replace the current upload with the public one this evening (in my defense, I did put that on e621 before I asked her). Thank you very much!

if you have permission from artist to upload the high res ones, i dont believe that there is anything wrong in it. but if the artist says no, then you should not upload them.

It doesn't matter what community you partake in, we're basically talking law here, not rules or policies. Ownership is generally joint between the artist and commissioner unless anything else is said, which means you generally have to respect multiple wills. Of course the artist can always refrain from their rights completely in which case the commissioner will get the full rights. If the commissioner does the same it will be in the public domain, though either of these cases (especially the latter) is probably quite rare.

Characters depicted in any work probably have very little legal support to lean against but I don't see the reason uploading something that someone closely related to the artwork has expressively wished not to be uploaded. It's just a dick move, even if it would be legal.

Also, when there are free versions and higher res paid versions, it wouldn't hurt to add a link in the "Source" field to the freebie one if that's what's uploaded, to make it clear at a glance that it is the freebie and not the restricted paid version.

(Mind you, sourcing regardless of the specifics is a pretty good idea. :) )

Cheers for all the clarifications. I checked and it, uh. It turned out I did upload the tumblr public version in the first place all along :P
