This post isn't very clear about the topic. You're having you're work deleted at request, but you're re-uploading afterwards, which users often do. So what's the issue?
(Who are you looking to sue? The website? Is that a joke?)

It sounds like you don't understand why your upload post #1658742 was deleted in favor of post #1615261.
post #1615261 is the same picture but bigger. e621 only keeps the best version of a picture.
