Let's say an artist named Artist_A is DNP here. Then he die, his death can be checked on a reliable source, and there is no other legal owner of his art. Do he stay on the DNP list?

It seems to me that it would be extremely disrespectful to take advantage of an artist's death by uploading his art.

I'd wager that the artist would remain on the DNP list regardless to keep their wishes/reasons intact.

Presumably if they have a clause in their will stating that they want someone to contact the e621 staff and take them off the DNP list, that would work, but otherwise they'd remain on the list forever.

Or perhaps until their works are old enough to be considered public domain.

I remember Charr discussing this in an ancient thread. He decided that it should stay DNP.

Yeah unless the art is like... Announced as free game in a will or maybe by a close family member/partner after death, then it would probably be super disrespectful to post their content honestly. Dead or not it's only fair to be respectful of other people's hard work on content they put a lot of heart into.

I would guess so. As it would be protected from those who would either use it for a means to gain personal attention and attraction. Dead is dead, very true. However, to use the art of a deceased artist in a detrimental way is wrong and disrespectful. Especially if you're just a random person with no legal rights to it. Sharing one's favorite pictures about is ok. As long as you don't pass it around like you're the original artist. With talks of "my pics" and et cetera.

Intellectual property of a deceased artist remains covered by copyright for 70 years following the artist's death. Ownership of the copyright goes either to the persons specified in the artist's will, or to next-of-kin if not specifically called out.
Source: US Code Title 17, Section 201(d)(1) (transfer of copyright) and "The US Copyright Office"https://www.copyright.gov/circs/circ15a.pdf (copyright duration).
So no, the art does not become public domain for at a minimum 70 years.

This would create a bad incentive to kill the artist, so no.

I have to agree it would be very disrespectful
The art would still make money
if it was in a bundled or set, with a company and by more then one artist.
it will still have a contract with anybody else it will still be copywritten.
Only the owner or group/company will say otherwise of ownership.
