character could be physically forced in that position with heavy implication that their body should not normally be able go into that position, or image could have a joke that character is trying to perform split but they cannot do it fully because they are too stiff

i really wouldnt count either of those as flexible

I can see where you're coming from. forced splits was the main point of contention I thought there might be. counterargument for that would be that they were forced to be flexible so the tag would still apply. for the joke point, if its mentioned in a joke but no one in the image is doing splits, splits shouldn't be tagged in that case right?
