Because characters can be drawn differently, in ways that's not a fan character (i.e. without any ties to the game/movie/comic/show/series/franchise they were created as a fan character of). And more specifically for your character in question, the ember (angstrom) wiki doesn't indicate what they're a fan character for, and the latest posts of her don't have a copyright indicating any franchise/series/show/comic/movie/game that they're be a fan character for. The wiki just says she's a humanoid blue fire elemental, so why should she be tagged with fan character?
