Just like posts, the creator has no extra permissions for pools. Best you can do is report it, explaining the situation.

Yes, but only if it has a valid reason to be empty (e.g. created by accident). Pools which contain only deleted posts do not themselves get deleted, and you can get a record for emptying them.
