Topic: Sourcing artwork from a free game

Posted under General

I recently posted artwork from Taifun Rider's game Shuggerlain. An older version of this game is free to play, which you can find here: https://taifunriders.itch.io/shuggerlain. I wasn't sure how to source these posts, so I just included Taifun Rider's Patreon as the source. I think this had the implication that I was sharing paid art straight from their Patreon, which isn't true. This art can be seen for free in the free version of their game.

What's the consensus on a situation like this? Am I allowed to post art from the game if I use a better source?

Things to consider: Posting Abuse, Posting Unreleased Content / Hacking Data Files, and Screen captures.

  • 1) Posting Abuse
    • Specifically "Do not post any commercial or pay-to-view content. "Free" pay-to-view content – where you are allowed to set the price to $0 if you so choose – cannot be posted unless 60 days have passed after it was made available for free."
    • You can break the Posting Abuse rules if you had released "free" pay-to-view content that has just been released less than 60 days after it has been made free.
    • You can also break the Posting Abuse rules if you had released paywalled content from Patreon that was not released for free yet (even if it is coming for free in a future update).
  • 2) Posting Unreleased Content / Hacking Data Files
    • You can break the Posting Unreleased Content rule if you released something from the paid version of the game, that has yet to be released on the free version of the game.
  • 3) Screen captures
    • Specifically "Screenshots from games, still images from movies, video snippets from YouTube, etc." and the exception "games and interactive media may have screen recordings captured by a developer."
    • You may upload official screencaps of the game that are released by the developer themselves publicly, such as the preview GIFs on the game's Itch.io page.
    • You may NOT upload any self-created screencaps or asset rips of the game.
    • You may also NOT upload screencaps that the developer had made of the "newer" paid version of the game, even though the "older" free version is publicly available.

End of the line is: 1) Do not upload anything that is only currently available on Patreon and has not been released publicly yet, and 2) Do not upload any screencaps, unless it is from the developers themselves.

Your posts were flagged as "Paysite/commercial content. (Patreon) / Screencap" because you had linked the Patreon source only, and thus, the automatic assumption that it has been pirated.
What you should have done is linked the Itch.io page of where you had gotten the screencaps and showed that it is released by the developers themselves.
