Well shit, there goes my main reason to go to tumblr. There's no Berry Pnuch, no Pinkmena, almost no Skoon, and now Molestia/Gamer Luna.
Aside from Ipsy and TheGoddamnDoomguy there's almost no point now.

I wouldn't worry about it though. They had nothing to do with it as the links provided stated. Molly was just taken down by complaints and they just wanted to move on without putting it back up.

Ill post it here too. But apparently bloggers have the same rights conserning the free speech amendment. Hasbro, pinkiepony, Alex Davis and any of the other "down with molestia" people can get sued for what they did since it violated jj's 1st amendment rights.

He wanted to end it already, it was just a merry coincidence. Not arguing that they have rights (It's parody after all).

I'm more pissed that the tumble was taken down itself instead of just not updating anymore, Hasbro has no right to do that.

They partly do, since it's their IP. But yeah, we have the posts here, and the original files are still accessible (because reblogs, even with those cryptic filenames tumblr uses). So, I don't worry much. Also, there are people who have been saving the images to their computers, possibly making an archive of them. I've read that JJ was thinking on releasing an archive too (can't remember where, though)

Parody is protected and does not fall under their copyright. They actually don't have the rights to take down the tumblr. But because they're a big corporation, they get listened to, instead of the law. It's disgusting really- You can see it with the huge Youtube fiasco.

They do however have the right to ASK for it to be taken down. Which they did and in this case it gave the owner an excuse to.. How shal I put it? Honorably discharge himself. Meaning he doesn't look like an ass for leaving his tumblr behind but at the same time he get's to leave.

I would caution any admin from giving legal advice. Rest assured that if anyone takes legal issue with our content, we will make sure they cross all the t's and dot all the i's before any action takes place.

The Hasbro/MLP situation has always been something we've kept an eye on.

Oh, sorry didn't mean to put anyone in the hotseat. It's just I could picture the entier site going belly up as the op said thanks to some idiot not getting their way and complaining enough yah know? Itssomewhat unsettling that pinkiepony aand that Hate group hasn't been stepped on yet. I mean they have the right to an oppinion true, but none to harrassment, and defaming (I think, I'm refering to making up lies) nor prejudices, its the same with anti-(insert item here) groups, they always find a loophole to exploit to get their way and rarely get curbstomped. :(

They have the right to ask for it to be taken down, to the creator and maintainer, NOT to the hosting site, which itself does not have the right to remove said content due to copyright attribution when the work is protected by law under parody clause. Of course, they have the right through other means to shut down any page immediately if they so choose, which neatly gets around that little issue. -.-

Regardless of what happens they can't force the site to shutdown.
They may try to protect their intellectual property, and that's a fairly complex legal question as to who would win the fight.
But, either way they have no legal recourse that would result in the complete removal of the website.

over mine too, this is the best furry centric porn site on the internet, and I've been here for about 3 years so I've seen a decent portion of it (though I lurked for a while of it)
on another note, I hope that jj not fighting back doesn't start a huge tumblr takedown avalanche with any nsfw mlp content, and honestly molestia was pretty tame most of the time, with mild perverted themes.

I already went through this back in June/July of 2011 I think. We had been contacted by a legal representative of Hasbro who said that we would need to remove all infringing MLP content due to a list of concerns they had. I spent the next few weeks exchanging e-mails with them to address their concerns as well as try to get more specific information. After a while, I simply never heard from them again, so I assume they determined that the issue of e621 hosting content that infringes Hasbro's copyrights and trademarks wasn't worth the time and money it would take to legally have the content removed. To my knowledge, we haven't heard from them since.

Of course they could just contact us again at some point and be more determined to have MLP removed, but perhaps they just don't care anymore either.

For the record, their copyright ISN'T being infringed by porn art of ponies, though they may try to claim as such to bully us into submission. Just wanting to clear that up, because the way you worded it implies that it is infringing and as such we are illegally hosting material that breaks copyright law.
