That situation is still a form of combat. Combat isn't necessarily physical, as evidenced by the definition ikdind posted (i.e., contend). At any route, that particular saying is modified by the word "intellect." That's what changes it's meaning. "battle_of_wits," or "battle_of_intellect" would be the proper tag in that situation, not "battle" alone.
But honestly, have you ever seen a an image of two furries playing chess, having a verbal debate or otherwise conflicting with one another in a non-violent manner and thought, "Golly gee! That's a battle of wits! I should tag that!"
