No they aren't, "avoid posting" doesn't mean "do not post", although we treat them as such when the tag appears because of some artist tags.
For example, all the current Frisky Feral content up on the site is here with the approval of Otterface, who represents the rest of the Frisky Ferals crew.

no I'm talking about images with a Do Not Post/Distribute written on the image. isn't that like saying i don't want my art to be posted elsewhere

This still does not mean that whoever uploaded the piece did not have permission to do so. It DOES mean that if the art is uploaded, it is very likely to be deleted at the request of the artist, but I feel that it is not e621's place to automatically assume that the artwork was uploaded without permission, even if it has "Do Not Distribute" on the image itself.
It's also very possible that artists may eventually have a change of heart, and decide that they don't really care too much about their artwork being distributed (just as long as they're properly credited and such). Again, their old art would say "Do Not Distribute", but they may actually be ok with it now.
We have a quick and efficient takedown system for a reason, as well as an Avoid Posting list. Those are what should be utilized for preventing artwork from being posted to e621, not a "Do Not Distribute" watermark that leaves us wondering how true it might be for our particular site. "Do Not Distribute" watermarks are their for the USERS to heed; the site itself should not make assumptions based on them.
