April 10th: The bill has been vetoed!
April 2nd: The politicians in Arizona are about to sign into law a bill that would mandate sites like e621 to either impose age verification on all users or be at a risk of lawsuits. Such system would be required to go through third party vendors, who in turn must go through a government database to verify every user's age. This is not only a major violation of privacy, but it also opens up a very real danger of identity theft through phishing schemes and other methods, not to mention that we would not be able to control any of that information to make sure it is permanently deleted after age verification is complete.
Unfortunately, Arizona is the state out of which e621 operates, which means that this law will almost certainly affect us if it is to pass. If want to help us ensure that this site can continue to serve you without being required to know who you are, please ask the Arizona governor to veto this bill.
Please, help us get the word out by letting others know about this issue.

MemberThat's not how fair use works. Fair use is a defense in court but needs to be proven in court to be legal. Before that point you are in a legal grey area where it could or could not be legal. I hate it but that's how it works.

If it's not for educational, critique or achiving uses or referenced in an otherwise fully original parody work (think Spaceballs or a parody cover of a song), then fair use doesn't apply. I don't know why people always reference fair use as a get out of jail free card for copyright infringement when it's pretty clear-cut. They didn't even put the song in 'copyrights', despite it being a literal copy-paste audio.
Should it be taken down? Probably not and probably won't. Is it copyright infringement to post something on the internet when parts of it don't belong to you? Yes. Absolutely.

MemberThe remix isn't done by the person who made the animation. Only the animation is. The animator just posted the clip with the remix attatched without listing it or the original song as copyright.
And even if they did, the good old rule of giving credit not taking away something being infringement still applies. It's a bit silly to get worked up about a meme AMV, I know, but the fact is that it is what it is, and people like to extend 'it's just an AMV of a popular song!' to justifying theft from smaller creators, which is when it gets dangerous and actually affects people. Creators deserve ownership and credit, and while we obviously can't and shouldn't stop people from playing around and having fun/being creative themselves, people shouldn't actively work to pretend that copyright doesn't exist and that this isn't the case, which is what they do when they quote fair use like a get out of jail free card.

MemberHowever, I have heard or artists getting copyright claimed/sued by Nintendo becouse the artist in question was making profit from their art, most others still make some profit from their commissions, but my understanding is that these are personal transactions and Nintendo can't claim anything against them, but I could just be spouting nonsense as I don't actually know what I think I do.
