Isn't death by penis implying that it did fit? It's just that the consequence of making it fit will likely be slightly detrimental to the health of the receiving character.

nether one is about the penis being sharp enough to stab or impale a characters insides. both are about the insertion being too big to fit if real life anatomical limitations are taken in consideration; but do fit under "furry logic"

The wiki clearly states that it'll_never_fit is only to be used when no penetration has occurred yet, and death_by_penis is supposed to be used on images where penetration is already happening.

As such both tags are mutually exclusive by the current definition and implicating them would make no sense.

  • If it is only partly inserted, shallow_penetration should be tagged.

I'd say additionally.

It'll never fit can still apply when the tip is already inside but the brunt of the thing is still outside.

Yes, it'll_never_fit still seems appropriate if the penetrating partner can only barely fit the tip in. But it shouldn't be used if more than that has been inserted. Therefore the implication doesn't work.
