Topic: Question on Rules for Posting Old Commercial Watermarked Artwork

I was recently trying to upload a very old comic from 2012 (9 years ago) produced by ClubStripes which from my understanding is now defunct. The only sites that I can seem to find it (via reverse SauceNao) on are e-hentai (https://e-hentai.org/s/37f4f0e7e3/514589) and Sankaku Complex (https://chan.sankakucomplex.com/?tags=parent%3A3210161) neither of which I particularly use -- hence it would be great to just have it on e6 lol.

It seems that most of the old clubstripes comics that are already on e6 -- all uploaded a number of years ago -- and all have the same watermarking. Afaik the artist luckypan is not DNP.

I do recall one instance in recent memory of someone's art or a comic that used to be here, got deleted for being commercial/pay content, and then got undeleted after it was no longer available to buy. However, I can't find the thread, so I can't check over the details (any extenuating circumstances, length of time since being unavailable, etc). So there is some precedence for allowing work that used to be commecial and that's no longer is available anywhere, but without seeing the specifics of that case, I can't say whether this would be the same or not.

For things that can still be bought, yes. The old rule was that it could be posted after 3 years of being published, even if it was still available to buy, but the updated rule is that pay/commercial content can't be posted regardless of how long ago it was published. But is it still pay/commercial content if it can no longer be bought through any official means (including patreon and other non-second-hand means)?

I would think no, but you at least have to do some digging around and should see if it's possible to contact the artist. Luckypan is very active on FurAffinity so it shouldn't be difficult to figure out the situation from them.
I don't know if that particular image is a part of it, but Luckypan is also selling Ephmeris which has "From Squees, to Mahnas, personal characters and so much more"

I'm pretty sure it's pool #11546, softpaw magazine has went down, so artist themselves decided to release the comic previously only featured in the physical comic at higher quality and digitally on their inkbunny. Similar situation recently with pool #22567 where tokifuji is releasing the comic publicly outside the hardblush website, because it being much older comic, even when hardblush is still the publisher. Also remember a lot of similar situations, if I recall from at least Scappo.

In other words, our current stance on paid material is that if it was meant to be released freely, the artist would do so publicly, instead of us forcing them arbitary limits for how long they can monetize the content. In most of these cases it's publisher who goes under, so it is usually artist who gets their rights back, so it's then up to them to decide.

It's not too dissimilar situation to stuff like old video games, where sometimes it's literally impossible to get a hold of copy of it, but it's still technically up to the current copyright holder to manage it. This was the reason why I was personally initially againts changing the rules from 2 years old paid content being fine to not allowing paid material at all, but at the same time this is not too differend from any other medium and services.
