Wow you're so lucky. I asked the artist if I could upload this and they said absolutely not.

Which means he uploaded without permission.

    Added source and tags.

If an artist puts something on the internet, and it's not on a pay-to-view site, there is no reasonable expectation of privacy. He has no case. *A+ in Criminal Justice*

That's...not in any way, shape, or form true. Do you not understand basic copyright law?

This is possibly a more moronic discussion than the posting of ponies.

Actually it's pretty blatantly a copyright violation, to anybody that even knows the basics of how copyright law works (as stated).

Though I'm not sure on this site's stance (I assume it's takedown/list by request) so I'll not get into whether it belongs here or not.

Well I'm not gonna go posting something that the artist doesn't want posted. That would be disrespectful and reflect poorly on the site as a whole.

  • If you post something on a freely accessible site, after payment for eventual commission is received and the image is then subsequently posted elsewhere, for non-profit.. then there is no violations.
However, if an image is posted on a free site, and then re-uploaded without consent to a paysite, then we can talk about violation. Same goes for the inverted option (original upload to paysite, then re-upload without consent to free site).

  • my understanding is if you upload something on a free site you immediatly lose all copywrites to it.

that may just be on certain freesites tho, i know it's at least true for photobucket.
