MemberSeriously? Wonder why they would pick HIM out of all the artists using their IPs for profit. Maybe it's meant to be a warning shot, randomly hit someone so the others know they ain't safe. Good to see that Kuroodod seems to be still going strong even after what happened.

MemberIt's not just Kuro. Apparently they hit Diives with a DMCA a while back, last year they sued Soulja Boy and the owners of LoveROMs for distributing roms and emulators. And 2 years ago they hit the devs of AM2R with a DMCA before it was released, even though the game would've been released for free. Nintendo's gotten more defensive over their IPs in recent years, it looks like.
But if you think about it, both Kurodood and Diives were almost exclusively Pokemon artists. Not saying I support Nintendo's actions, just something I noticed. Although I am afraid of the possibility of them continuing or widening their radar to artists that take commissions without Patreon.

MemberTo be fair, Soulja Boy was asking for it, the dude is absolutely nuts for doing something like that. Now, I don't have any clue about american/japanese copyright laws, but any DMCA they sent out costs them money, so there's gotta be some reason for em to think shooting for these folks is worth it. I get the fan games more than I get the porn artists tbh, cause those are actually on Nintendos own turf, they dont sell porn though, so brand confusion can't be the reason here.

Again, Nintendo has killed off porn of their IPs before. Japan does not have laws protecting parody as fair-use, unlike the US.
As a general rule, Ninty tends to get more defensive about IPs that are about to see a major instalment released or updated (hence Diives and Kuro due to Sword and Shield, Brawlbrstms3 due to Smash, and AM2R due to Samus Returns).

MemberIt might not be the porn itself, but that these are (in the furry fandom, anyway) high-profile artists making a living drawing mostly Pokemon art, that just happen to draw porn. And their popularity could be interfering with Nintendo's official advertisements and trends, Like a few years ago when Rule 34 Pokemon searches actually beat official searches on Google. I mean, Diives in particular has their own section on Knowyourmeme and was trending for a while, and that was pretty much all Pokemon art. Also consider that they might not be the only artists Nintendo had their eyes on. I can think of a few more, but I won't name them in case there are spies roaming about.

MemberAha, there we have it: New pokemon game comes out, so people are gonna focus on the brand for a while, don't want unknowing parents to stumble upon porn while searching for that game their child wanted so they do some cleanup beforehand.
Also, Ky: I don't think Nintendo would bother sending spies on friggin e621 to look for pokemon porn, they can just google that shit. They would only target high-profile artists anyway, the small fry aint worth the effort.

MemberThis logic fails for AM2R and Brawlbrstms3 - AM2R is a fangame, while Brawlbrstms3 is a music extensions YouTube channel. It also fails when you consider that Nintendo also regularly C&Ds (admittedly high-profile) Pokemon fangames.

MemberLike I said, fangames just generally make sense cause they are on their own turf, there's the issue of losing sales cause of em or brand confusion, hell, they might even lose their copyright if they just sit idly and let others make games using their IP. This is why this stuff happens even if there is nothing coming out in the near future. I think Chrono Trigger Resurrection falls under that.
If there IS something coming out, that's when they go hard on anything, be it fangame or not, cause that's when a lotta money is on the line for em. Still just speculation of course.

Memberdude according to former Disney (or Pixar not really sure) they basically show them (i assume censored) rule umm 34? (if it exist there is porn of it) and they inform them this is what the internet will do to your characters... so im pretty sure Nintendo is woken enough to probably have a department to literally run a rule 34 search for their characters amd like you said it it a preemptive clean up

MemberPersonally, I think as long as they put their own spin on it and don't just trace the originals it's fine. Humans have made things that were not made by them their own and adapted it to their own needs since the beginning of history, it's how the cultures we have today formed in the first place.
That's from a personal philosophy standpoint tho, from a law standpoint, Nintendo could probably hit em way harder if they really wanted to.

MemberFirst, Disney is an American company. Nintendo is Japanese. American copyright law allows for parody under fair-use (and Rule 34 falls under this); Japan's does not.
Second, as I've explained twice before, Nintendo has no qualms about shutting down porn by buying out the copyright. Issuing a C&D/DMCA is more realistic in this instance.

MemberSouljaboy was trying to ship a rombox claiming it as his own work that had straight up NES and SNES ROMs on it. They didn't bother going after the original because it was Chinese, and the Chinese government basically builds in copyright theft protection as long as you aren't stealing Chinese work. Copyright law in China is a game of Calvinball and the Chinese government always wins. But Souljaboy gave them an American target under US law, and got eviscerated.
And they shut down AM2R because they had their own Metroid 2 remake in development and announced it a while later.

MemberIt's Nintendo being Nintendo. Trying to cover up the more popular side of the Pokemon fandom. Little do they know, the Pokemon r34 draws more sales of the game from people that haven't played a Pokemon game before. However, Nintendo is always trying to get their copyrighted material taken down across all platforms. Hell, even on YouTube the music extension channels draw in a helluva lot of sales to the game. It's a good marketing strategy, but they fail to see it.

BlockedI highly doubt this is a money thing. As far as things go, people are paying for a service and not the products. Unless someone can show proof otherwise, the money Kuroodod gets from patrons is for the creation of art and not the art itself.
Really, this whole thing stinks to me. Nintendo had no issue for years, but all of the sudden (coincidentally with a new Pokemon game on the horizon :thinking:), Nintendo starts hitting artists. Me thinks there is more to this than meets the eye. Surely, if this was about people making money off their IP, they would go after porn artists who draw explicit images of their other characters, right? Right?!
And don't tell me this is because "they need to protect their IP". Copyrights can not be rescinded because they go uncontested. Disney made damn sure of that. No, this is not a trademark issue.

If the artist is American, and American law allows the art, then Nintendo should have no legal ground.

MemberYou forget that Nintendo has an American subsidiary that they can ask to do this for them, and in this case the question of American law allowing the art isn't in Kuro's favour given he was targeted due to his Patreon. The reason I pointed out Nintendo being Japanese is for context; Nintendo is not going to be as friendly towards even clean parodies as a Western one.
Making money off of someone else's IP is considered theft, and the fact that Ninty went for a C&D/DMCA can be seen as a warning shot. They were well within their rights to sue Kuro (and Diives, while we're at it) into a hole.
