I could be wrong, but I do believe that there is no rule stopping the user from being able to use this piece as an avatar if they so wish to do so, regardless of who owns what. If you do not wish to have this piece featured on E621 since you are the character owner, you could submit a takedown request instead if it bothers you. Hope this helps! :0
