I think the key here is "on his Patreon anymore."

Both Legendary Tail and Oversexed Eeveelutions were Patreon comics. They were funded through Patreon and posted there a few days before being put on other sites. Nintendo didn't like the fact he was profiting off of Pokemon porn, so they C&D'd him. He can still make Pokemon and Nintendo art, as long as he isn't profiting off of it from Patreon.

I'm pretty sure that's the case, anyway. I'm not a legal expert, so correct me if I'm wrong.
