The tags were decided to be male, so no, you don't change them. Homu and Warp were both punished for this, its stated Quite clearly. This does not invalidate shemale or herm as tags on OTHER pictures, but their not to be used on here.

The funniest part about it all, to me, is that since this "incident," I've probably come across two hundred or more pony dickgirl/futanari pictures that should be tagged as "male" according to Celestia and the other admins here. They should literally all be tagged as male unless they have breasts, by the logic in this thread, since my pony's long eyelashes, long hair, and feminine face shape isn't enough. Dear, if you'd like to change the rules become an admin. Until then, I think it's best you realize you're not in a position of power. I can understand the "Artist" POV where it's a character that's dear to your heart, but this is a porn site and nobody cares for sentimentalism. You're better off on FA, Inkbunny, or any number of other more "honorable" sites that will take it in an "as is" basis. We know what they are, but if there's no genitals visible then it's assumed there are none for that ONE image... if you want one that has those details then you use those tags.

I personally only respect authority when I feel they deserve it. I was actually instantly unbanned by Char when I e-mailed him with a link to the thread, then he unbanned me a second time whenever I made the "recent" comment above, because it apparently upset Celestia. I would also like to note that Celestia has had her admin powers stripped away since this happened. The whole thing was pretty hilarious, and ridiculous, and I'm glad it made some people laugh. :p People really are quite silly sometimes.
