    The Harkness test -- references Captain Jack Harkness, from Dr. Who and Torchwood, who had a reputation for sleeping with just about anything legally able to provide consent. The short requirements for the test are as follows:

    • Does the sapient creature have human-or-greater intelligence?
    • Can it talk/communicate in some form of language?
    • Is it of sexual maturity of its species?

    If the sapient in question possesses all three traits, they're able to consent to sex.
    To tie this all back into the image, from all the lore (dex entries, movies, anime, et al), pokémon are largely considered to be within one standard deviation of average human intelligence (some outliers exist, often psychics on the upper end), and there's a number of them (often but not exclusively psychic-types) able to converse in some fashion. So all that would make one, such as the nice Espeon in the image, pass the test is being of an age/state of maturity for an espeon.
