H3h3 was sued for three main reasons ("claims"): copyright infringement, misrepresentation, and defamation.

Infringement Claim

The judge said h3h3's reaction video did not infringe on the copyright of the video they were reacting to because H3h3's video met the criteria of Fair Use. H3h3's reaction video used clips from Hoss's video, but H3h3 also offered enough "comment and critique" to change the original meaning of those clips ("transformative"). Misrepresentation Claim

H3h3 skipped the judge's ruling on the misrepresentation claim, which alleged that H3h3's counter-takedown notice misrepresented H3h3's copyright over their reaction video. Basically, Hoss claimed H3h3's video, H3h3 claimed it back (? the counter-takedown), and the misrepresentation is Hoss saying, "no, I own your reaction video anyways", I think. They both can't be right, so Hoss accused H3h3 of abusing DMCA's mechanisms, which is apparently a separate offense from copyright infringement. Since the judge found H3h3's reaction video not in violation of Hoss's copyright, the misrepresentation claim couldn't be true and was invalid.

Defamation Claim

The defamation claim was basically grasping straws, and seemed to use for evidence comments from H3h3 in a separate "Lawsuit" video (a video from H3h3 announcing the lawsuit). In order for the defamation claim to succeed, H3h3 must have stated some "false facts" ("actionable opinions", I Googled that one ) about Hoss. The judge found that whatever false facts Hoss accused H3h3 of stating were either opinions or would not have changed the public's opinion of Hoss, so H3h3's comments didn't fit the legal definition of defamation. The judge also found reason to disagree with Hoss's ("hyper-literal", "strained", "unsupported") interpretation of H3h3's comments.

Footnote

The judge also offered a potentially precedent-setting comment on the Fair Use status of the reaction video genre. "Some reaction videos, like the Klein video, intersperse short segments of another's work with criticism and commentary, while others are more akin to a group viewing session without commentary. Accordingly, the Court is not ruling here that all 'reaction videos' constitute fair use." On the one hand, the judge made a distinction between types of reactions videos, further implying that not all reaction videos are Fair Use. On the other hand, we know H3h3's video is Fair Use for the reasons stated by the judge, so H3h3's reaction video may become a de facto legal example of Fair Use reaction videos (and maybe broader commentaries) if this issue is brought to court again.

Disclaimer telling people not to be idiots make unfounded assumptions that I might have any legal training (I don't) just because I offered an interpretation of a legal document. Here's an 87 minute video, which I haven't watched, from a lawyer who has followed this case from the beginning.

Okay, thanks for the paraphrased transcript. And, yeah, even if it is from a lawyer, you should never take any statement as concrete fact when it comes to law. It's up to the judge's own opinion (just as our moderators make the decision whether or not to permit images) how to settle the case.

Yup! Have a lot of friends with all sorts of backgrounds now, can watch stuff without getting mad, not upset about drawings :p Made it easier to get along with my family, too.

Also making me happy rn: finding new stuff in Fallout New Vegas I had no idea about til now. I've got like 2k~ hours in that game but had no idea abt some hidden areas.

boy, who knew "him" had such mighty power. that was probably his biggest moment in the entire series to date in a number of ways.

fruit punch? *reads label* 0% juice...

it's little more than fruit flavored water really. well, fizzy fruit flavored water but still. could probably make about the same thing with some kool-aid mix and club soda assuming it stays fizzy long enough to get cold.

i mean, i don't dislike that stuff but i would like some actual fruit JUICE every now and then. though i suppose that'd be more expensive. >.>

Games with seasonal and holiday-specific content. It's a nice little touch that many developers can (within reason) include in their games but often don't.

Too bad the holiday content usually only covers Christmas, Easter and Halloween. It's very rare to see other international holidays covered (Valentine's Day, Father's Day, etc.) and country-specific ones (Australia Day, Independence Day, etc.) are almost never covered.

At least with soda, you kinda expect it to not have juice in it unless it explicitly tells you it does. Fruit drinks, on the other hand, fool you into thinking they're all juice when they are ~25% at most. The rest is flavouring and water, and maybe some vitamin C.

I have a morbid curiosity and honestly seeing a picture of the Vegas shooter lying dead in his own pool of blood made me happy.

It's a shame it was self inflicted though, and he didn't give a chance for the police to do the dirty work.

I found myself with time and inspiration, so I put this together. Probably overdid it, but such is the affect of reading a Poe story.

true story

I had just entered a crowded hallway after extracting myself from the commotion in the adjoining room. I recognized someone going the other way and called, "Hey! [Name]!"

He turned, saw me, and started heading my way, leaving the two girls by his side, one presumably his girlfriend, the other more her friend than his, because that's how it always went. The girls began squawking. I cut them off before they could really get going. "Can't I talk to my fucking best friend for five or ten fucking minutes?" Any response they may have offered went utterly unnoticed by the both of us.

I hadn't seen him in many years, not since we were in high school together, and even then we seldom saw or spoke to each other in the concluding years. But when we found ourselves with similar proximity and opportunity to talk, I remember he always seemed to have time for me, a behavior in clear contrast to the others in our group of friends, whom all befell the same gradual, uncontrollable, and irreversible distancing from me, thus underlining the strengths of our friendships. And so it was again.

We sat down on a hitherto unnoticed bench behind me that may as well have materialized as our need made itself known.

"What-" he was beginning for us.
"When?" I started asking in our excitement, before I had formed my own question, leaving it hanging there.
"Right now." He hadn't missed a beat somehow, but I certainly had.
I looked directly at him, my own slight confusion and frustration probably reflected in his expression, pleading almost, while I tried processing this botched exchange, and decided I needed us to start over.
I braced myself to admit, giddy and breathless, "I have no idea what I'm asking." Yet I was the one who called him over.

We both had followed the strangled pulses and wordless reverberations of this conversation, I knew, our intuitions reading the intent of the other far beyond his current ability to express, as sometimes happens with close friends. The hopeless absurdity was too much! Our tension snapped and we broke out laughing. I doubled over, enfolding my arms at my waist, and he stood up and walked away, outlining a keyhole with his path.

I doubt I've laughed that hard for that long in years. Then I woke up.

Definitely a happy experience, but also melancholic.

This community makes me happy. Nice to find people with similar interests, and it's also nice to see that this place isn't filled with a bunch of SJWs. At least not from what I can tell. That surprised me.

Also, people aren't afraid to criticize artwork here. I like that. Granted, I don't see critical comments all that often anyways. But when they do appear, they're usually deserved in one way or another. The few times negativity does actually surface... some artists complain about it? I know that not all criticism is constructive but come on, this is the internet! What do you expect? People want to speak their minds is all. That's healthy and should be encouraged as far as I'm concerned. You know, just take the criticism into consideration.

People shouldn't be forced to appear nice all the time. I'd rather hear somebody post their own true thoughts about art, instead of lying and pretending to like it. If feelings are hurt, who cares? As long as nobody is being blatantly racist or part of a hate group, you know?

And often the weirdo comments are singled out and down-voted/hidden anyways. So the community seems to self-moderate itself in a way.
