If he planned this in advance, this might actually be a gift in disguise. Assuming he put a different SIM card in there so he doesn't lose his phone number, all he needs to do is assume she'll take the phone, then call her and tell her he's already replaced it and the phone is hers now.

Now
a) He can call her whenever he wants
b) She has a mobile phone - assuming this takes place in the present day that might help her pull her life together

Caveats - someone needs to pay for service (which can be levered by the suit), and the phone will need a charger to remain useful. (Though she can certainly afford a cheap charger right now, especially if that's not a fruit phone)
