AI art is generated from training data of some sort. What images were used to train the AI? Is that content illegal or not. Is it copyrighted or public domain? Are AI generated images subject to copyright law or is it considered fair use.
One way or another AI images are generated from other images, so I think its fairly obvious to say anything generated is a derivative of the models source data. And considering the fact that Copyright law is Absolutely prehistoric in terms of dealing with advances made in modern technology and media use practices (just look at the shitstorm of YouTube copyright issues) OHH boy theirs a lot to unpack and debate there.

TLDR: "Would an AI capable of making hyper-realistic CP be ethical, since it's not real children?" IMO IF the model data is free for public use, IF it contains no real children (of ANY sort Safe or otherwise) I would struggle to call it ethical, but would deem it "acceptable" But there is a whole lot of other legal shit that needs to get figured out along the way.

Just correcting you in saying that the cub tag is automatically added to the blacklist on new accounts and non-account sessions. While I've never added cub to my blacklist and don't intend to (entirely indifferent about the art itself), it was never added even with the recent blacklist system changes.
